These Terms of Service (“Terms”) govern your use of the GO-BOSS platform (“Service”) provided by Eyeuniversal LLC d/b/a GO-BOSS (“GO-BOSS,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms.

1. SERVICES

GO-BOSS provides software tools including:

  • CRM and pipeline management
  • Marketing and workflow automation
  • AI-powered communication (email, SMS, voice)

GO-BOSS is a technology platform only.

2. PLATFORM ROLE (IMPORTANT)

GO-BOSS does not initiate or send communications.

You are solely responsible for:

  • who you contact
  • when you contact them
  • the content of communications
  • obtaining all required consent

GO-BOSS acts solely as a software provider and not as the sender or initiator of communications.

 

3. CUSTOMER RESPONSIBILITIES

You agree to comply with all applicable laws, including:

  • TCPA
  • CAN-SPAM Act
  • GDPR

You are fully responsible for:

  • your contact lists
  • consent collection and storage
  • opt-outs and suppression lists
  • all communications sent using the platform

4. ACCEPTABLE USE

Your use of the Service must comply with our Acceptable Use Policy, incorporated by reference.

5. AI AND AUTOMATION

The Service may include AI-powered or automated communication features.

You are responsible for:

  • how AI is configured and used
  • ensuring communications are lawful and not misleading
  • disclosing AI use where required

GO-BOSS does not control AI-generated content.

6. THIRD-PARTY SERVICES

The Service relies on third-party providers (e.g., carriers, email systems).

GO-BOSS is not responsible for:

  • delivery failures
  • message blocking or filtering
  • outages or interruptions

7. FEES AND BILLING

  • Fees are billed as agreed
  • Subscriptions automatically renew unless canceled at least 30 days prior
  • Fees are non-refundable unless stated otherwise

If payment is not received:

  • Service may be suspended immediately
  • Late fees may apply

8. MINIMUM COMMITMENT

If your plan includes a minimum term, you remain responsible for all fees for the full term, even if you stop using the Service.

9. NO GUARANTEES

GO-BOSS does not guarantee:

  • leads
  • revenue
  • conversions
  • business outcomes

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

GO-BOSS liability is limited to fees paid in the previous 3 months.

GO-BOSS is not liable for:

  • indirect or consequential damages
  • lost profits
  • regulatory penalties

11. INDEMNIFICATION

You agree to indemnify and hold GO-BOSS harmless from any claims arising from:

  • your communications
  • your use of the platform
  • violations of applicable laws
  • lack of proper consent

12. THIRD-PARTY / AGENCY USE

If you use the Service for clients or third parties:

  • You are fully responsible for their actions
  • You ensure their compliance
  • GO-BOSS has no relationship with your clients

13. OUTBOUND COMMUNICATIONS

 The Service may be used for outbound communications where permitted by law.

You agree to:

  • target appropriate recipients
  • avoid complaint-generating practices
  • include opt-out mechanisms

GO-BOSS may restrict or suspend campaigns that create risk.

14. RESTRICTED USE

GO-BOSS may refuse or terminate service for high-risk activities, including:

  • unlawful lead generation
  • deceptive marketing
  • adult content
  • gambling (where restricted)
  • high-risk financial schemes

15. CHARGEBACKS

You agree not to initiate chargebacks without first contacting us.

If a chargeback occurs:

  • You remain responsible for all fees
  • Service may be terminated
  • You may be liable for related costs

16. SUSPENSION AND TERMINATION

GO-BOSS may suspend or terminate your account immediately if:

  • you violate these Terms
  • your activity creates legal or reputational risk
 

17. DISPUTE RESOLUTION

All disputes will be resolved through binding arbitration in San Diego, California.

You waive:

  • jury trial
  • class action participation
 

18. FORCE MAJEURE

GO-BOSS is not liable for events beyond its control, including outages, carrier issues, or regulatory actions.
 
19. ENTIRE AGREEMENT
These Terms represent the entire agreement between you and GO-BOSS.

You must use the Service lawfully and responsibly.

2. COMMUNICATION COMPLIANCE

You are solely responsible for complying with all applicable laws, including:

  • TCPA
  • CAN-SPAM
  • GDPR
  • CASL

This includes:

  • obtaining proper consent
  • honoring opt-outs
  • maintaining records
3. PROHIBTED ACTIVITIES

You may NOT:

Unlawful communications

  • send messages in violation of applicable laws
  • contact individuals without required consent
 Deceptive practices
  • use misleading sender information
  • impersonate others
  • make false claims
 Abuse or harmful activity
  • generate excessive complaints
  • ignore opt-out requests
  • distribute harmful or illegal content
 Technical misuse
  • hack, reverse engineer, or disrupt the Service
  • bypass safeguards or security
 4. DATA RESPONSIBILITY

You are responsible for:

  • all data uploaded
  • consent records
  • privacy compliance
5. INDUSTRY COMPLIANCE

If you operate in a regulated industry, you are responsible for complying with applicable laws.

The platform is not designed for storing payment card data or sensitive regulated data.

 
6. ENFORCEMENT

GO-BOSS may:

  • suspend or terminate accounts
  • remove content
  • report violations

Immediate termination may occur without notice.

7. MONITORING
We may monitor usage using automated systems to detect violations.
8. CHANGES
We may update this policy at any time.
